Renewal of Business Manager Visa|Explain requirements, required documents, and what you can do to extend your period of stay!

In order for foreigners to continue their business in Japan, it is necessary to renew their business manager visa. Some of you may be worried that if your next visa renewal is not accepted, you may not be able to do business in Japan.

In this article, we will explain the necessary documents and requirements for renewing a business manager visa, and what you can do to extend your period of stay.

Requirements for Renewal of Business Manager Visa

Renewal of a business manager visa can be said to be more difficult than other types of visas. This is because the conditions for renewing a business manager visa are required to be the same as those for new acquisitions. In addition, whether the visa can be renewed is examined from the perspective of whether it is properly managed and managed properly.

First, let's take a closer look at the requirements for renewing a business manager visa.

Suitability of the Applicant

In order to renew the business manager visa, it is necessary to properly pay the taxes stipulated in Japan (income tax, corporate tax, resident tax, etc.), submit various necessary notifications, and meet the social needs of the employee. The suitability of the applicant, such as insurance coverage, will be examined.

Non-payment of taxes and non-fulfillment of tax obligations can be a significant disadvantage in the review of visa renewals.

Fulfillment of Obligations as a Business Operator

The following are required as the obligations of the business operator of the business manager visa holder.

Securing a place of business

For business establishments, short-term monthly contract properties and simple stalls cannot be specified. In other words, it is a condition that it occupies one parcel and is in a certain place.

In addition, it is necessary to indicate that the intended use of the property is for business purposes such as stores, businesses, or offices. If part of a residential property is used for business, etc., it must also be shown that the landlord agrees to the terms.

Tax Payment etc. as a Company

You are required to pay the national taxes set by Japan without delay. Pay corporate tax, income tax, and local tax (resident tax, etc.), and keep the proof as a document.

Enrolling into Social Insurance, Suitable Working Environment, etc.

Employed employees, including non-regular employees, are required to be appropriately enrolled in social insurance and to comply with labor-related laws and regulations.

If your business is covered by labor insurance, welfare pension, health insurance, etc., be sure to properly enroll and pay insurance premiums.

Business Continuity

It is desirable to judge whether the continuity of the business is stable, whether the sales are stable and if the company is making a profit (using financial statements). However, even if there were any deficits at the end of the most recent fiscal year, or even if there was excess debt, there may be cases where it is recognized that there is business continuity.

No Deficit at the End of the Most Recent Fiscal Year

If there is surplus at the end of the same FY and net income is in the most recent FY, it is considered that there is business continuity.

If there is a surplus at the end of the most recent FY, or if there are no deficits or surpluses, it is likely that there will be no problem in continuing the business.

Excessive Debt does not Drag on for More than a Year

Considering future business plans, etc., there are cases where it is possible to continue the business even if there is debt at the end of the most recent fiscal year.

By submitting a document that describes the business plan and sales forecast for the next year, it is basically recognized that there is business continuity.

In addition, if the company has excess debt at the end of the most recent FY but did have excess debt at the end of the previous FY, it may be possible to demonstrate that it is possible to continue its business by obtaining a diagnosis from a third party (such as a certified public accountant or small business consultant) who is a holder of official qualifications that can perform corporate evaluation.

You can request a specialist to prepare a written document on "the prospect that the continuity of the business can be improved precariously" and submit that document at the time of renewal of the business administration visa. If, after close examination, it is determined that the business is expected to improve, the visa can be renewed.

How to Get A Visa Validity of 3 or 5 Years with a Business Manager Visa

Unless you are a company with a name value or a large company, the period of stay permitted for a business manager visa is usually one year. Let's take a look at the conditions that must be met in order to be granted a period of stay of 3 or 5 years.

Stable Fulfillment of Obligations and Business Continuity

In the first two years, if business revenue and sales continue above a certain level, it is judged that the operation is stable. In this case, a 3-year or 5-year long-term business manager visa will be approved for the next renewal.

In addition, it is also important to fulfill the obligations of business operators and managers, such as tax payment, social insurance enrollment procedures for employees, and payment of insurance premiums.

It is an important factor for the business to be in profit when applying for renewal of a business manager visa. Nevertheless, we do not recommend to lower the representative's compensation in order to make it profitable.

There is no clear guideline, but it is highly likely that if the remuneration for directors and/or representatives are set lower than the average salary of a new graduate, it will not be recognized as a stable continuation of the business.

Submission of Medium- to Long-term Business Plans

We recommend that you create a medium- to long-term business plan for the next 3 or 5 years and submit it as an additional document at the time of renewal. Specifically, the method of raising funds, employee recruitment plans, sales forecasts, etc. will be required.

In addition, businesses with multiple employees and capital investment tend to be more highly evaluated by immigration than businesses run by one person. If you have a track record of stably operating your business, prepare and submit documents that show the fact that you have multiple employees and the track record of capital investment.

Summary

It can be said that the examination for renewal of the Business Manager Visa is relatively strict, but if the business stability can be proven, there should be minimal problems. Renewal requirements include:

・If the business will continue under stable management.

・If the business (applicant) individual tax payments and various notifications were all done properly.

・If the business maintained a suitable working environment for employees, paying appropriate taxes as a company, etc.

If you meet these requirements, there will be no problem in continuing business in Japan – proceed to renew your business manager visa and continue your business!
